General conditions of Sale

These General Conditions of Sale have as their object the regulation of the purchase of products and services, carried out remotely and made available, via the Internet, from the site www.cinturinieaccessori.it (hereinafter referred to as the "Site").
These General Conditions exclusively regulate the contractual relations between the site's customers (hereinafter referred to as "Customers") and the site, belonging to the company LA PASSIONE PER IL TEMPO of VITTORIO BEVILACQUA with headquarters in via Torino 86/c 10034- Chivasso (to ), Italy, registered in the Turin business register with VAT no. 10429150013. Cinturinieaccessori.it invites each Customer to carefully read these General Conditions before carrying out each purchase operation and, once the purchase procedure provided by the site has been completed, to print them and keep a copy or save them in electronic copy.
Cinturinieaccessori.it may modify, at any time and without notice, the content of the General Conditions referred to in this document. Any changes made will take effect from the date of publication on the Site.

Warranties

Cinturiniandaccessori.it ensures the quality and authenticity of all the products sold.
All items are shipped in their packaging and, where applicable, with a certificate of authenticity and originality of the product issued by the manufacturer.
All products are guaranteed for 12 months from the date of purchase against any manufacturing defect.
In the event of proven malfunctioning of the item, the warranty may provide for the replacement or repair of the same.
Damages caused by bad or improper use are not guaranteed.
It should be noted that cinturnieaccessori.it is not responsible for direct or indirect damages to persons or things resulting from the malfunctioning of the products.
With the purchase order, the customer confirms in fact the full acceptance of the conditions of sale set out above.

Purchase procedure

The Customer can purchase the products present in the electronic catalog of the Website, as described in the relative information sheets contained in the Website, respecting the technical access procedures illustrated therein. The publication of the products and services displayed on the Website constitutes an invitation to the Customer to formulate a contractual purchase proposal. The order sent by the Customer has the value of a contractual proposal and implies complete knowledge and full acceptance of these General Conditions.
Correct receipt of the Customer's proposal is confirmed by cinturinieaccessori.it by means of an automatic reply sent to the e-mail address communicated by the Customer and only confirms the correct receipt of the proposal within the information systems. In addition to the information required by law, the message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections.
Each purchase contract stipulated between the Website and the Customer must be considered concluded with the acceptance of the order by cinturiniaccessori.it
Cinturinieaccessori.it has the right to accept or not, at its discretion, the order sent by the Customer, without the latter being able to make claims or rights of any kind, in any capacity, including compensation, in case of non-acceptance of the order same. The acceptance of Cinturinieaccessori.it is considered tacitly released, unless otherwise communicated to the Customer within 48 hours of sending the order, by means of an e-mail message sent to the address communicated by the Customer.
After Cinturinieaccessori.it has sent the confirmation response, in the event that Cinturinieaccessori.it finds (due to technical or formal errors) the incorrectness of the price and/or characteristics published on the Website, of the products and services covered by the Customer's Proposal, Cinturinieaccessori.it will expressly notify the customer of this, inviting him to make a new proposal, if still interested.
By sending the order, in the various ways provided by the operating instructions of the Site, the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept the General and Payment Conditions below described.

Prices and availability of products

All product prices are clearly indicated on the Website and are inclusive of VAT. They do not include any additional and different taxes, duties or duties established by the relevant applicable legislation, such as those foreseen on importation. As necessary, the Customer will therefore have to clear the imports through customs and pay any duties and taxes (other than VAT) possibly due in the importing country.

Packing, shipping and delivery

The ordered goods are prepared by our staff with extreme care, using suitable packaging that protects the items from possible knocks.
For the national service we only use the GLS express courier
For foreign shipments we use the international registered mail service carried out with POSTE ITALIANE.
If the customer requests another courier, the shipping cost will be recalculated based on the destination and the size of the package.
The delivery of the order will be carried out by the Courier at STREET FLOOR, on Working Days (from 08:30 to 18:00).
You can track your package through the Site after receiving the shipment notification by e-mail. We remind you that shipments can be monitored 24/48 hours after receiving the e-mail reporting that the package is being prepared.
Upon delivery of the products by the courier appointed by Cinturinieaccessori.it, the Customer is required to check:

(a) that the number of packages delivered corresponds to what is indicated in the transport document;
(b) that the packaging is intact, not damaged or otherwise altered, even in the sealing materials.

In case of breakage or tampering with the package, please do not accept the package and contact us immediately. Any damage to the packaging and/or products or the mismatch in the number of packages or indications must be immediately contested by the Customer, writing "ACCEPTED WITH RESERVE" on the courier's delivery receipt. Furthermore, the Customer undertakes to report promptly - and in any case no later than 8 (eight) days from the date of delivery - to Cinturinieaccessori.it (by sending a message to info@lapassioneperiltempo.it) any and all possible problems concerning the physical integrity, correspondence or completeness of the products received.
Cases of force majeure, unavailability of means of transport, as well as unforeseeable or inevitable events which cause a delay in deliveries or make deliveries difficult or impossible or which cause a significant increase in the cost of delivery to be borne by Orologeriamajer.it will entitle Cinturinieaccessori.it to split, postpone or cancel, in whole or in part, the expected delivery or to terminate the Purchase Agreement. In such cases, Cinturinieaccessori.it will provide timely and adequate communication of its decisions to the e-mail address indicated by the Customer and the latter will be entitled to a refund of the price already paid, excluding any further claim, for any reason, against Cinturinieaccessori. .it

Right of withdrawal

The right of withdrawal is governed by Legislative Decree no. 21 of 21/02/2014 which regulates the matter of consumer rights. The withdrawal determines the possibility for the consumer to return the purchased product and to obtain reimbursement of the expenses incurred.
This right is reserved exclusively for natural persons (consumers), therefore it cannot be exercised by legal persons and natural persons acting for purposes related to any professional activity carried out.
Before proceeding with the return of the goods, we ask you to carefully check that the following conditions are met.

- return the product within 14 working days from the date of acceptance of the return by Cinturinieaccessori.it

- the product must never have been used, must not be damaged or dirty;
- the product must be returned in the original case and packaging, with the original instruction booklet and certificates and tax receipt
- the shipment must be notified via e-mail with the notification of the shipment date, the service used (mail/express courier) and, if possible, the waybill number;
- the right of withdrawal does not apply to personalized engraving products;
- in case of return of a purchase made through PayPal, it remains the responsibility of the buyer.

The costs of returning the product are the responsibility of the customer.
The articles for which you want to assert the withdrawal must be sent back with appropriate means and the right of withdrawal is lost in the event of damage or loss of untraceable or uninsured packages, for which Cinturinieaccessori.it is in no way attributable to responsibility
The right of withdrawal gives rise to a full refund of the expense incurred if the returned product is intact and with the original packaging (never opened package).
Insufficient packaging of the box in which the object is sent will void the right of withdrawal in the event that the product arrives damaged (boxes that are too light, absence of bubble wrap or scotch tape, etc.).
The right of withdrawal applies no later than the fourteenth day from receipt of the goods even for "products that are not intact", i.e. with packages open but not damaged or missing parts essential for use or instructions. The consumer is only responsible for the diminished value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics and functioning of the goods. In these cases, the value of the products must be re-evaluated by specialized technicians, considering the decrease in value attributable to the opening of the package and improper handling. The refund will be granted on the basis of the lower value of the returned goods, the total amount of the refund in these cases cannot exceed 50% of the initial purchase value paid.
The indicated duration of 14 days is counted from the date of delivery of the order.
Cinturinieaccessori.it will proceed with the transmission of the re-credit order relating to the cost of the goods shipped within 14 working days following receipt of the returned goods.
It will consequently reject any product for which the return costs have not already been paid in full by the Customer.
The refund is made by bank transfer, re-crediting of the sums to your credit card or, at the customer's choice, with a purchase voucher with no time limits on the Site for an amount equal to that of the returned products (100% of the amount paid for the products excluding all shipping costs).
In the case of products with packaging that is not intact or handled in a clearly improper way, the methods and timing of the re-credit remain, but the total refund, in this case, will take into account the decrease in the value of the goods and can in no case be higher 50% of the amount paid for the goods (net of all shipping costs).
The right of withdrawal is exercised without any penalty, except for the return costs, which remain the responsibility of the Customer.

When the right of withdrawal expires

The right of withdrawal is lost in cases where Cinturinieaccessori.it ascertains:

1) Even partial use of the asset;
2) The lack of the external packaging and/or the original internal packaging;
3) The absence of integral elements of the product (accessories, parts, ..);
4) Damage to the product for reasons other than its transport;
5) Personalized or made-to-measure goods are excluded from the right of withdrawal.
Cinturinieaccessori.it will not proceed with a refund for returns that do not comply with all the conditions indicated above.
